Terms of Service

1. Acceptance of Terms

By registering, accessing, or using TusomePlus ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of the platform including Learners, Parents, Teachers, TusoTeachers, and Administrators. If you do not agree to these Terms, you must not use the Platform.

TusomePlus reserves the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms. Users will be notified of significant changes via email or platform announcements.

2. Platform Authority & Administration

TusomePlus is managed by a dedicated Administration team. The Admin holds full authority over the platform including but not limited to:

• Approving or rejecting content submitted by TusoTeachers
• Approving or rejecting TusoTeacher applications
• Processing and verifying withdrawal requests in accordance with platform policy
• Taking appropriate action on accounts that violate platform Terms, including temporary suspension or account review
• Setting and adjusting pricing, subscription plans and revenue sharing
• Making final decisions on all platform disputes
• Modifying platform features, content and policies
• Issuing announcements and communications to all platform users
• Entering into school partnership agreements on behalf of TusomePlus

The Admin's decisions are final and binding. Any disagreements must be raised through the official channel: tusomeniplus@gmail.com.

3. User Accounts & Eligibility

• Users must be at least 18 years old to register independently without parental consent
• Learners under 18 must have parental consent
• You must provide accurate, complete and up-to-date information during registration
• You are responsible for maintaining the security of your account password
• You must not share your account credentials with others
• One person may not maintain multiple accounts
• TusomePlus reserves the right to verify user identity at any time
• Accounts with false or misleading information will be terminated immediately

4. TusoTeacher Terms & Obligations

TusoTeachers are subject to additional terms and obligations that cover content quality, timeliness, professional conduct, earnings and prohibited conduct.

TusoTeachers can view their full Terms & Obligations after logging in at /tusoteacher-terms. These terms are confidential and for TusoTeachers only.

5. Learner Terms & Obligations

• Learners must use the platform for personal educational purposes only
• Sharing account credentials or subscription access with others is prohibited
• Learners must not attempt to download, copy or redistribute platform content
• Cheating on quizzes or assessments — including using unauthorized assistance — is prohibited
• Learners must treat TusoTeachers and other platform users with respect
• Harassment of TusoTeachers or other learners will result in immediate account suspension
• Learners must not attempt to contact TusoTeachers outside the official platform channels
• Any attempt to solicit private tutoring from TusoTeachers outside TusomePlus is prohibited
• Learners under 18 must have parental consent and are subject to parental monitoring

6. Parent Terms & Obligations

• Parents are responsible for monitoring their children's use of TusomePlus
• Parents must provide accurate information when linking children to their accounts
• Parents may link up to 5 children to a single Parent Monitor account
• Parents must not use child accounts to access adult content or bypass restrictions
• Parents are responsible for ensuring their children use the platform appropriately
• Parents must not share their children's login credentials with unauthorized persons
• Parents who contact TusoTeachers directly to solicit private tutoring will have their accounts suspended

7. Teacher Terms & Obligations

• Teachers may access schemes of work, lesson plans and CBC materials for professional use only
• Platform resources must not be shared commercially outside the platform
• Teachers must maintain professional conduct in all interactions on TusomePlus
• Teachers using the meeting room feature must ensure sessions are educational and appropriate
• Misuse of teacher access to learner data or content is strictly prohibited

8. Subscriptions & Payments

• All payments are processed via M-Pesa STK Push
• Subscriptions are billed monthly and renew automatically unless cancelled
• Access to paid content is granted immediately upon successful payment confirmation
• TusomePlus does not store M-Pesa PIN or card details
• In case of payment failure, access will be restricted until payment is confirmed
• Prices are displayed in Kenya Shillings (KES) and are subject to change with notice

9. Refund Policy

TusomePlus offers refunds under the following conditions:

• Refund requests must be submitted within 48 hours of payment
• Refunds are subject to Admin review and approval
• Refunds will not be issued if content has been extensively accessed after payment
• Technical payment errors will be refunded in full within 5 business days
• Refunds are processed via M-Pesa to the original payment number
• Live class fees are non-refundable once the class has been attended
• To request a refund, contact tusomeniplus@gmail.com with your M-Pesa transaction reference

10. Account Suspension & Termination

TusomePlus reserves the right to suspend or terminate any account for the following reasons:

• Breach of any of these Terms of Service
• Providing false or misleading information during registration
• Non-payment of subscription fees
• Inactive accounts (no login for more than 90 days for learners, 60 days for TusoTeachers)
• Harassment or abusive behaviour towards other users
• Fraudulent activity or misuse of the platform
• Any conduct that damages the reputation of TusomePlus
• Legal requirements or court orders

Upon termination, access to all platform content will be immediately revoked. TusomePlus is not liable for any loss resulting from account termination due to Terms violation.

11. Intellectual Property

All content on TusomePlus — including notes, quizzes, assessments, reading passages, lesson plans, the TusomePlus logo, mascot (Sungura), and platform design — is the intellectual property of TusomePlus or the respective TusoTeachers.

• Users may not reproduce, distribute or sell any TusomePlus content without written permission
• TusoTeachers retain copyright of their original content but grant TusomePlus a licence to host and distribute it
• TusomePlus may use anonymized learning data for platform improvement and research
• Unauthorized use of TusomePlus branding or content will be pursued legally

12. Limitation of Liability

TusomePlus provides the platform on an "as is" basis. We do not guarantee uninterrupted access or error-free operation. TusomePlus shall not be liable for any direct, indirect, incidental or consequential damages arising from use of the platform, including but not limited to loss of data, missed assessments due to technical issues, or reliance on platform content for examination preparation.

13. Dispute Resolution

In case of any dispute:

• Users must first contact Admin at tusomeniplus@gmail.com with full details of the dispute
• Admin will respond within 5 business days
• If unresolved, disputes will be subject to Kenyan law and jurisdiction
• The Admin's decision on all platform-related matters is final

14. Governing Law

These Terms of Service are governed by the laws of Kenya. Any legal proceedings arising from these Terms shall be conducted in Kenyan courts.
